This policy explains how Orkestro Energy ("Orkestro", "we") collects, uses, and protects personal data in compliance with the EU General Data Protection Regulation (Regulation 2016/679).

2.1 Information you provide voluntarily
- Pilot request form: your name and work email address, submitted via the form on our website.
- Direct correspondence: any information you choose to share when emailing us at info@orkestroenergy.com.
2.2 Information collected automatically
- Technical logs: we do not currently operate analytics tracking, cookies, or advertising pixels. Our website is hosted on infrastructure that may keep standard server logs (IP address, request timestamp, user agent) for up to 30 days for security and operational purposes.
3. Why we process your data
- To respond to your enquiry — legal basis: legitimate interest (Article 6(1)(f) GDPR).
- To assess pilot suitability and follow up — legal basis: legitimate interest or pre-contractual steps at your request (Article 6(1)(b) GDPR).
- To comply with legal obligations — accounting, tax, anti-fraud (Article 6(1)(c) GDPR).
We do not sell, rent, or share your personal data with third parties for marketing purposes. We do not perform automated decision-making or profiling on personal data.
4. Where data is stored
EU data residency by default. Personal data submitted via this website is stored on infrastructure located within the European Economic Area. Form submissions are routed through FormSubmit.co (USA) solely for delivery to info@orkestroenergy.com; no permanent storage occurs at the FormSubmit endpoint. We are evaluating a fully EU-hosted form-handler for the commercial release.
5. How long we keep data
- Pilot enquiries — retained for up to 24 months after last contact, then deleted, unless a contractual relationship is established.
- Email correspondence — retained for the duration of the business relationship plus 6 years (accounting requirement).
- Server logs — up to 30 days.
6. Your rights under GDPR
You have the right to:
- Access the personal data we hold about you (Article 15).
- Correct inaccurate or incomplete data (Article 16).
- Request deletion (Article 17 — "right to be forgotten").
- Restrict processing (Article 18).
- Data portability — receive your data in a structured, machine-readable format (Article 20).
- Object to processing based on legitimate interest (Article 21).
- Lodge a complaint with the supervisory authority of your EU Member State (the national data-protection authority).

7. Customer data during pilots and commercial use
During pilots and commercial engagements, Orkestro acts as a data processor on behalf of the customer (data controller). The terms of processing are governed by a separate Data Processing Agreement — see DPA.
Specifically: Orkestro does not access workload contents, model weights, source code, customer payloads, or any application-level data. We process only cluster utilisation telemetry and public electricity market signals.
8. Cookies and tracking
This website does not use cookies, third-party analytics, or advertising trackers. If this changes, this policy will be updated and a clear consent banner will be presented before any non-essential cookies are set.
9. Changes to this policy
We may update this policy from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be communicated by email to all parties with whom we have active correspondence.
